General Terms & Conditions of Business

1. Scope

The following terms and conditions apply to all orders placed through our online shop by consumers and businesses.

For Germany: Consumers are defined according to § 13 BGB as any natural person who enters into a legal transaction for purposes that predominantly cannot be attributed to their commercial or self-employed professional activity.

For Austria: In the following terms and conditions, "consumers" are understood to mean "consumers" within the meaning of the Consumer Protection Act (KSchG).

For Switzerland: In the following terms and conditions, "consumers" are understood according to Swiss law.

Regarding businesses: If the business uses conflicting or supplementary general terms and conditions, their validity is hereby contradicted; they only become part of the contract if we have expressly agreed to them.

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially add our products to the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the ordering process. By clicking the order button, you submit a binding offer for the goods contained in the shopping cart. We will confirm the receipt of your order immediately by email after sending the order.

The purchase contract is only concluded after we accept your offer by

  • issuing a declaration of acceptance in a separate email, or
  • you receive a separate shipping notification for your order

The relevant alternative for you depends on which of the listed events occurs first.

3. Language of Contract, Storage of Contract Text

The language(s) available for concluding the contract: German

We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.

4.  Delivery Conditions

In addition to the specified product prices, shipping costs may apply. You can find more details on any applicable shipping costs in the offers.

In principle, you have the option of picking up the goods at music world / Meinolf Kahrig e.K., Hasselborn 53-55, 59929 Brilon, Germany during the following business hours: Monday to Friday 9:30 am to 6:00 pm

We do not deliver to packing stations.

5.  Payment

In our shop, the following payment methods are generally available:

Prepayment
If you choose the prepayment option, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

Cash on delivery
You pay the purchase price directly to the deliverer. There are no additional costs for this.

Credit card
By placing the order, you provide your credit card details. Your card will be charged immediately after placing the order.

PayPal, PayPal Express
To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. You will receive further information during the ordering process.

PayPal may offer additional payment methods to registered and selected PayPal customers based on its own criteria. However, we have no influence on the offering of these modalities; further individually offered payment modalities concern your legal relationship with PayPal. PayPal Plus
In cooperation with the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), we offer you the following payment options as PayPal services. Unless otherwise specified below, payment via PayPal Plus does not require registration with PayPal. You will receive further information on the respective payment option and during the ordering process.

To pay the invoice amount via the PayPal payment option, you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order.

Credit card via PayPal
Your card will be charged by PayPal after the goods have been dispatched.

Direct debit via PayPal
Payment by direct debit via PayPal requires an address and credit check and is made directly to PayPal. By confirming the payment instruction, you grant PayPal a direct debit mandate. You will be informed by PayPal of the date of debiting your account (so-called prenotification). Debiting your account will occur before the goods are dispatched.

Invoice purchase via PayPal requires an address and credit check and is made directly to PayPal.

Sofort by Klarna
To pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have an online banking-enabled bank account, authenticate yourself accordingly, and confirm the payment instruction. Your account will be charged immediately after placing the order. You will receive further information during the ordering process.

Amazon Pay
To pay the invoice amount via the payment service provider Amazon Payments Europe S.C.A. 38 avenue J.F. Kennedy, L-1855 Luxembourg ("Amazon"), you must be registered with Amazon, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out within one banking day after placing the order. You will receive further information during the ordering process.

Klarna
In cooperation with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment via Klarna is only available to consumers. Unless otherwise specified below, payment via Klarna requires a successful address and credit check and is made directly to Klarna. You will receive further information on the respective payment option and during the ordering process.

Invoice purchase via Klarna
The invoice amount is due 30 days after dispatch of the goods and receipt of the invoice.

Instalment purchase via Klarna
You can pay the invoice amount in monthly instalments of at least 1/24 of the total amount. The minimum instalment amount is €6.95.

Klarna credit card
You provide your credit card details during the ordering process. Your card will be charged by Klarna immediately after placing the order. An address and credit check is not carried out.

Klarna direct debit
You grant Klarna a SEPA direct debit mandate. Klarna will inform you of the date of debiting your account (so-called prenotification). Debiting your account will occur after dispatch of the goods.

Purchase on installment via Santander Consumer Bank AG
In collaboration with Santander Consumer Bank AG, located at Santander-Platz 1, 41061 Mönchengladbach, Germany, we offer you the option of installment purchasing. A successful address and credit check are required. In addition to our terms and conditions, the terms and conditions of Santander Consumer Bank AG apply for payment processing. Further instructions, including the terms and conditions of Santander Consumer Bank AG, will be provided during the ordering process.

Cash payment upon pickup
You will pay the invoice amount in cash upon pickup.

6. Right of Withdrawal

You have the statutory right of withdrawal as described in the withdrawal policy.

7. Reservation of Title​​​​​​​

The goods remain our property until full payment is received. For customers based in Switzerland, we are entitled to make a corresponding entry in the reservation of title register.

For entrepreneurs: We reserve the right to ownership of the goods until full settlement of all claims arising from an ongoing business relationship. You are permitted to resell the reserved goods in the ordinary course of business; however, you assign all claims arising from such resale to us in advance, regardless of any connection or mixing of the reserved goods with a new item, up to the amount of the invoice, and we accept this assignment. You remain authorized to collect the receivables, but we may also collect the receivables ourselves if you fail to meet your payment obligations. Upon your request, we will release the securities to which we are entitled, insofar as the realizable value of the securities exceeds the value of the outstanding claims by more than 10%.

8. Transport Damage

For consumers: If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your statutory rights and their enforcement, especially your warranty rights. However, you assist us in asserting our own claims against the carrier or transport insurance.

For entrepreneurs: The risk of accidental loss and deterioration passes to you as soon as we deliver the item to the carrier, freight forwarder, or any other person or institution designated to carry out the shipment.

9. Warranty and Guarantees​​​​​​​

9.1 Warranty Rights

Statutory warranty rights apply.

For consumers based in Switzerland::
As soon as it is feasible according to normal business practices, you should examine the condition of the received item and, if defects arise for which the seller is liable, notify the seller immediately. If the consumer fails to do so, the purchased item is considered approved, provided that the defects were not recognizable during customary inspection. If such defects arise later, the notification must be made immediately upon discovery, otherwise the item is also considered approved with respect to these defects.

Please return the defective product to us with a description of the defect. You bear the incurred transport costs. We provide warranty by rectifying defects. This is done at our discretion either by eliminating the defect (rectification) or by delivering a defect-free item (replacement delivery). If the subsequent performance fails, you are entitled to withdraw from the contract. This does not apply in the case of minor defects. The right to price reduction is excluded.

9.2 Guarantees and Customer Service

Information on any applicable additional guarantees and their exact terms can be found on the product and on special information pages in the online shop.

10. Liability

We are fully liable for claims arising from damages caused by us, our legal representatives, or agents

  • in case of injury to life, body, or health,
  • n case of intentional or grossly negligent breach of duty,
  • in case of guaranteed promises, if agreed, or
  • to the extent the scope of the Product Liability Act applies.

In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations), our liability is limited to the foreseeable damage typical for the contract, the occurrence of which must typically be anticipated.
Otherwise, claims for damages are excluded.

You can secure orders placed with us free of charge up to a certain order value through the buyer protection of Trusted Shops AG. In addition, Trusted Shops, together with a guarantor, offers a chargeable coverage. The Trusted Shops buyer protection conditions apply, which you can find here. The conclusion of buyer protection is made by clicking on the appropriately labeled button of the so-called Trustcard, which appears as a pop-up on the order confirmation page after placing an order. If you are already registered for buyer protection, your order will be automatically secured (automatic buyer protection) without clicking the button. In order to offer you (automatic) buyer protection, the Trustcard must access order data stored in your browser cache. For this purpose, a hash value of your email address as well as the order number and order amount are transmitted to Trusted Shops. If you are not yet registered for buyer protection, you can register via the Trustcard as described above. 13. Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are willing to participate in out-of-court dispute resolution proceedings before a consumer arbitration board. The Universal Arbitration Board of the Federal Government at the Center for Arbitration e.V., Strasbourg Strasse 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de, is responsible.

14. Final Provisions

If you are an entrepreneur, German law applies, excluding the UN Sales Convention.

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our place of business.
